Project Description
The applicant proposes to construct a 19 x 29 foot, 516 sq foot, flat-roofed permanent post and beam outdoor dining addition to the front of the existing restaurant structure with a 42” breezeblock wall enclosing the dining area. An additional 9 x 11 foot, 84 sq feet uncovered, 42” high breezeblock-enclosed dog rest area is proposed to extend towards the sidewalk. No planters are included with this design. The ADA ramp railings will be replaced, and the applicant will also change the exterior paint scheme and remodel the interior of the 3420A suite. There will be no increase in interior space or reduction in fenestration.

Variation(s) Requested: Two
Recommendations Regarding Variations:
Two variations from current SPI-9 codes are required for this proposal. Both variations relate to the outdoor dining area and wall construction:
- 16-18I.017.6.a.ii. – Outdoor dining utilization of 36” movable planters (applicant proposes to use 42” breezeblock walls)
- 16-18I.017.6.b – No fences or walls between building and street (applicant includes use of the breezeblock walls to enclose a dog rest area between building and street.)
The DRC recommended approval of the two variations above for the following reasons:
- The proposed breezeblocks do allow some visibility into the dining and dog areas.
- The proposed walls allow the applicant to raise the dining area to improve drainage and easier ADA access to the space while maintaining the required life safety requirements per building code.
- The applicant will also include planters and/or landscaping improvements to add greenery to soften the wall’s appearance.
- The improvements add value to the community, particularly as it pertains to the dog area.
Additional recommendations for the applicant
The Development Review Committee recommended the applicant add a striped crosswalk from the sidewalk to the entrance for improved visibility to drivers. Additionally, they recommended the restaurant owner connect with Livable Buckhead if interested in marketing and promotional opportunities, available to them via the local TMA (§16-18I.024).
The Development Review Committee DOES NOT expect to see this applicant again UNLESS significant changes are required to the proposed plan that necessitate substantial re-review and/or variations that will require additional input from the DRC.
