Description: The applicant is proposing to construct an all-weather, street facing patio, approximately 634 square feet in size. The enclosure, which will have a rated occupancy of 43 people, replaces the existing outdoor dining area along Pharr Road. This addition will consist largely of steel and glass with sliding windows. It will occupy the entirety of the supplemental zone and will project into the walk zone for 82 linear feet. This will reduce the walk zone to approximately 7 feet. It does not change the overall fenestration values but represents a slight expansion of the current use.

Recommendations Regarding Variations:

Two variations are potentially needed for the submitted plans:

  • 16-18I.015.2 – Walk Zone Requirements
  • 16-18I.016.3.c.i Supplemental Zones Adjacent to sidewalk-level non-residential uses

The DRC recommended the applicant reach out to the architect and engineer and have them set up a pre-application meeting to go over the code implications of the request as-is and explore alternative designs that would minimize or eliminate the need for variations.

Additional Recommendations:

The DRC recommended that the design team explore the following alternatives to the submitted plan set:

  • Ensure the doors do not open into the walk zone.
  • Consider alternative designs that reduce or eliminate the extension into the walk zone.
  • Compare whether a linear expansion into the walk zone could be replaced with bump-outs that extend out from the existing windows only.
  • Show on the plans any deviation in elevation required for construction due to the slope change present on site.
  • Cut the eastern extent of the expansion to ensure sufficient visibility for cars entering and exiting the parking garage via the curb cut of the sidewalk at that location.
  • Review the 2021 recommendations for the earlier submitted plan below.

2021 Tabla Recommendations

In an effort to minimize the reduction of the sidewalk clear zone, the committee recommends the applicant reduce the length of the proposed outdoor dining area by approximately 5 feet on the end adjacent to the main entrance of the establishment.  This reduction will maintain a substantial sense of arrival while relieving some of the constriction of the clear zone for the block face as a whole.

Provided the applicant accommodates these changes and because the proposed plan is associated with a restaurant use that only allows for seated dining in the outdoor area and does not include any temporary serving or bar areas in the outdoor area, the committee recommends approval of the requested variation.

The Development Committee DOES expect to see this applicant again as significant changes are required to the proposed plan that necessitate one or more variations and will require additional input from the DRC.
