Recommendations Regarding Variations:

Section 16-18I.0176(iii)(2):  The applicant is requesting a variation to allow for the incorporation an 8 foot fence in an effort to provide a secure area for outdoor merchandise.  Per the code, the maximum combined height of fences where otherwise authorized and retaining wall shall not exceed height of 5 feet unless topography prohibits retaining walls of lesser height.

Recommendation:  The committee recognizes the need to secure the outdoor merchandise and notes the existing retaining wall and recommends approval of the variation requested.

Sec. 16-29.001(25): Fence Definition Fence: Any structure forming a physical barrier or enclosure which is so constructed that at least 50 percent of the vertical surface is open to permit the transmission of light, air and vision through said surface in a horizontal plane.

 Recommendation:  The committee recommends the applicant incorporate a fence detail into the SAP submittal that specifies the construction of the fence and meets the requirements of this section to ensure visibility through the fence is provided from the sidewalk.

  The Development Committee does not expect to see this applicant again unless significant changes are made to the proposed plans that necessitate additional variations or the City staff requests additional input from the DRC.
