Lost Dog Tavern (3182 Roswell Road) – Third Visit

Description: Second visit.  According to the Applicant it took some time to get the required parking agreement in place.  The interior patio is permitted and the lower patio is not.  The goal is to get a building permit for the patio that is already constructed.

Recommendations

The applicant provided updated plans demonstrating compliance with previously identified concerns noted below.  These plans indicate the demolition and replacement of the front patio to meet code requirements.

 

Section 16-18I.016(6)(B) The fence constructed around the outdoor bar area in the rear of the site  appears to exceed the allowed six foot maximum height.

 

Recommendation:  Submitted plans indicate the fence is 6’ in height; therefore, the code requirement is satisfied and no variation is necessary.

 

Section 16-18I.017(6)(II)  The fence along the outdoor dining in the front of the development appears to exceed the code requirement of a maximum of 36 inches .

RecommendationPlans submitted by the applicant indicate the demolition of the existing front patio which does not comply with code requirements.  The plans for the replacement patio satisfy the code requirement; therefore, no variation is required.

 

Section 16-18I.017(6)(II):  Fences and walls for outdoor dining must be movable.

Recommendation:  Applicant should revise plans to satisfy the code requirement.

 

Section 16-29.001(25)(b)  Fence: Any structure forming a physical barrier or enclosure which is so constructed that at least 50 percent of the vertical surface is open to permit the transmission of light, air and vision through said surface in a horizontal plane.

Recommendation:  Applicant should revise plans to satisfy the code requirements.

 

Off-site Parking Agreement – the committee notes the plans indicate opening hours for the Lost Dog to begin at 9:00pm in order to allow for the off-site parking to be available.  The businesses currently using the offsite parking all close at 8pm, so the applicant might consider moving the opening hour up to 8:30 if desired.

 

The Development Committee does not expect to see this applicant again unless significant changes are made to the proposed plans that necessitate additional variations or the City staff requests additional input from the DRC.
