Project Scope: The applicant has a pending liquor license that has been held for several months awaiting approval of the SAP. The modifications to the property are related to changing it from a night club to partial restaurant use.

Variation Requested: Section 16-18I.023(b)(II)(5) Spaces used to satisfy code requirements through shared parking agreements are required to be signed and cannot be shared with multiple properties during allotted hours. 

Recommendation:  The applicant represented that his attorney has thoroughly  researched the dedicated spaces to ensure there are no conflicting agreements  assigning them to another user during the required times.  The applicant has also signed the areas generally, but has not individually marked each space and raised aesthetic concerns about doing so.  He has indicated a willingness to work with the committee to determine a design standard that will be more appropriate for the district.  In light of these concerns and strategy to revise the code, the committee recommends the city approve the SAP with the condition that the applicant install signage once agreed upon with the DRC.

The applicant does expect to continue working with the applicant to establish appropriate parking signage.
