Recommendations Regarding Variations:

 This property was provided with the following recommendations as a result of their initial visit to the DRC in July, 2011.

The committee does not support the variation for the parking arrangement as proposed due to concerns over the safety of pedestrians accessing the parking.  Specifically, requiring pedestrians to cross a state highway with no reasonable crossing opportunities to do so creates a hazardous condition that is not acceptable. 

 In order for the committee to support an off-site parking variation, the off-site parking agreement needs to be within the required distance specified by the zoning code as well as located on the same side of Roswell Road.  The applicant is encouraged to seek a new master parking agreement with properties that meet this condition whereas the Applicant shall submit to the committee that alternative parking agreement for consideration.

 Recommendation:

The committee commends the applicant for taking necessary steps to bring the property into compliance with the zoning requirements.  However, the committee finds the parking agreement the applicant has been using to provide parking for this location unacceptable as it is the same as presented and denied in 2011 being across Roswell Road.  Therefore, the request to satisfy the off- site parking requirements by adding spaces at 3210 Roswell Road is not sufficient.  The applicant still must find 16 spaces that meet the requirements noted above.  The applicant must present valid parking agreements for all spaces meeting these requirements.

The applicant is advised that the off-site parking locations must be brought into compliance with the surface parking lot landscaping regulations (Section 16-28.026) as well as be in compliance with section 16-18I.023(5)(b)(3).

The applicant is further advised that the hours of operation of the proposed businesses located at 3210 Roswell conflict with the hours for the parking restrictions noted in the agreement and on the proposed signage.

Additionally, for the committee to consider providing comment on the SAP for the addition of the front and rear areas, the applicant must provide plans and elevations for each area.
